Trend Connection Homes Terms and Conditions
Effective date: November 1, 2026
These Terms and Conditions explain the conditions applying to Trend Connection Homes’ website, Standard Inclusions, inclusion collections and promotional offers.
Read the general provisions together with the section relevant to your selected inclusions or promotion and the documents issued for your project.
1. General Terms and Definitions
1.1 In these Terms and Conditions, Trend, we, us and our mean Trend Connection Pty Ltd ABN 45 101 504 205, operating as Trend Connection Homes.
1.2 Client, you and your mean the individual or entity enquiring about or purchasing a home or service from Trend. An individual entering into an agreement must be at least 18 years old. A person acting for another person or entity must have authority to do so.
1.3 Building Contract means the residential building contract entered into between Trend and the Client, including its incorporated plans, specifications, schedules and agreed variations.
1.4 New Home Tender means the written tender and associated pricing documents issued by Trend for the proposed home.
1.5 Preliminary Agreement means the agreement or other written document governing preliminary services provided before the Building Contract.
1.6 Project Documents means the applicable New Home Tender, Preliminary Agreement, Building Contract, plans, specifications, inclusions schedules, selections documentation and agreed variations.
1.7 Lot means the nominated parcel of land on which the home is to be constructed.
1.8 Main Dwelling means the principal home forming the subject of the Building Contract. Unless expressly stated otherwise, it excludes a granny flat, detached secondary dwelling, shed or other separate structure.
1.9 Duplex means two attached dwellings on one Lot, designed and constructed under one Building Contract.
1.10 Project:Home means the colour and selections studio and authorised consultants through which Trend administers selections for the Client’s home.
1.11 Builder’s Range means the identified range of products, materials, colours and finishes available within the Client’s selected inclusions package and recorded in the Project Documents.
1.12 All monetary amounts are in Australian dollars and include GST unless expressly stated otherwise. All dates and times refer to local time in Sydney, New South Wales.
1.13 These Terms and Conditions do not themselves constitute a Building Contract or oblige a Client to engage Trend. Applicable inclusion and promotional terms will be provided before the Client pays to secure the relevant offer.
1.14 The Building Contract governs construction, payments, variations, completion, termination and contractual remedies. These Terms and Conditions supplement the Project Documents for the relevant inclusions or promotion and do not retrospectively amend a signed agreement.
1.15 Applicable law takes priority over these Terms and Conditions. The agreed contractual order of precedence governs the Project Documents. A specific promotional provision takes priority over a general promotional provision only for that promotion.
1.16 Any material departure from an advertised inclusion or offer must be clearly explained and expressly agreed before the Client commits, subject to applicable law. Nothing in these Terms and Conditions excludes responsibility for misleading representations or removes rights arising from them.
1.17 Trend may update these Terms and Conditions for future enquiries and offers. Updates will not retrospectively reduce inclusions or benefits already secured under an existing agreement or promotion, except as lawfully agreed or required by law.
2. Standard Inclusions
2.1 Standard Inclusions are the baseline specification supplied with a Trend home as identified in the applicable New Home Tender and Building Contract. They are not a separate promotional credit, cash allowance or representation that every feature displayed in a display home is included.
2.2 The applicable Standard Inclusions brochure edition and any agreed changes must be identified in the Project Documents. A subsequent brochure or website update does not remove an inclusion already contracted for.
2.3 Inclusions depend on the selected home design, façade, configuration and the express qualifications accompanying each item. Quantities, dimensions and locations are determined by the applicable plans and specifications.
2.4 Items described as “subject to design” apply where the selected design provides for them. Features specific to double-storey homes, including stairs and first-floor construction, do not create an equivalent additional entitlement for single-storey homes.
2.5 The Standard Inclusions brochure describes an M-class engineered concrete slab. This is a baseline pricing assumption and is not a representation that the Client’s land has an M-class site classification. The actual foundation design must satisfy the site’s engineering and statutory requirements.
2.6 Unless an agreed upgrade replaces them, ceiling heights, roof materials, façade treatments, windows, doors, cabinetry, appliances and finishes are those stated in the applicable Standard Inclusions schedule.
2.7 A gas cooktop, gas bayonet or gas hot-water system is subject to gas availability and applicable requirements. Where an alternative appliance, energy source or additional connection work is required, its scope and price must be disclosed and agreed through the relevant Project Documents.
2.8 Water-tank and recycled-water inclusions are subject to the qualifications stated in the applicable brochure and the project’s BASIX and authority requirements. The final tank capacity, connections and reuse arrangement must be identified for the site.
2.9 Standard tiling, flooring and wall finishes extend only to the rooms and areas expressly listed. Wet-area floor tiles and specified splashbacks do not mean that all living areas or all walls are tiled. Additional coverage, full-height tiling and premium tile ranges require express inclusion or a priced upgrade.
2.10 Electrical inclusions comprise the specified points, outlets, switches, alarms and fittings. A light point or batten does not include a decorative fitting or downlight unless expressly stated. Additional electrical capacity, circuits, outlets, data cabling, charging equipment and other electrical work require express inclusion.
2.11 Insulation, glazing, ventilation, waterproofing, smoke alarms and other regulated components must comply with the requirements applicable to the project. Historical brochure specifications do not authorise non-compliant work. The compliant specification and any properly chargeable additional costs must be disclosed through the New Home Tender or lawful variation process.
2.12 Unless expressly included in the Project Documents, Standard Inclusions exclude additional site works, upgraded façades, landscaping, fencing, retaining walls, driveways, pathways, decks, pools, window furnishings, furniture and decorative items. This provision does not exclude an item expressly included under a selected collection or promotion.
2.13 Granny flats, secondary dwellings, dual-living areas and Duplexes require an inclusions schedule identifying the rooms, dwellings and quantities covered. Standard-home quantities are not automatically duplicated because the design contains another kitchen, bathroom, living area or dwelling.
2.14 Changes to Standard Inclusions must be priced and agreed through the applicable tender or variation process. Any adjustment for deleted non-promotional work is determined by the relevant signed agreement and applicable law.
2.15 No brochure heading or description excludes statutory warranties, required insurance or other rights that cannot lawfully be excluded. Warranty and maintenance provisions are addressed in section 9.
3. General Conditions for Inclusion Collections
3.1 This section applies to the Altitude Collection and The Studio Collection.
3.2 The selected collection, applicable price, brochure edition, covered home and inclusion quantities must be recorded in the New Home Tender.
3.3 Collection upgrades replace corresponding Standard Inclusions. They do not provide duplicate appliances, fixtures or finishes unless expressly stated.
3.4 Only one inclusion collection may apply to the same home unless a specific written offer expressly provides otherwise. Neither the Altitude Collection nor The Studio Collection may be combined with the $30,000 Bonus Upgrade Promotion.
3.5 Standard Inclusions remain the underlying baseline specification and are not a competing promotional offer.
3.6 Unless expressly included in the collection schedule, collection benefits apply to the Main Dwelling only. Eligibility and quantities for Duplexes or additional dwellings must be confirmed before the Client pays to secure the collection.
3.7 Collections are packages of specified inclusions, not freely spendable credits. Client-requested deletion of a promotional inclusion does not create an entitlement to its advertised or retail value in cash, a refund, a discount or another item. This does not remove remedies for Trend’s failure to supply an agreed benefit or adjustments required by law.
3.8 A collection’s advertised value is distinct from its purchase price. An advertised value is not a sum payable to the Client or a guarantee of the Client’s individual saving. Any stated saving must be supported by an appropriate comparison for the relevant home and inclusions.
3.9 Selections must be made from the applicable Builder’s Range. Premium products, additional quantities, extended coverage, non-standard sizes, installation patterns and design changes may attract additional charges, which must be disclosed before acceptance.
3.10 The collection schedule must specify material details not quantified in the brochure, including:
- Floor-tile coverage and included rooms.
- Driveway area and included construction scope.
- Air-conditioning capacity, zones and outlets.
- Solar-system capacity and equipment.
- Stacker-door size and location.
- Bathroom tiling coverage and included rooms.
- Appliance models and relevant installation requirements.
These details must be disclosed before the Client commits to the collection. An unspecified brochure quantity does not permit an undisclosed limitation to be imposed later.
3.11 A dishwasher space and connections do not include a dishwasher unless expressly stated.
3.12 A 20mm benchtop description does not, by itself, include waterfall ends, thicker edges, additional splashbacks or premium material selections. The selected material must be legally available for supply and installation.
3.13 Ceiling-height references are nominal structural heights unless the Project Documents expressly state finished heights. Floor finishes, ceiling finishes, bulkheads, beams and services may affect the finished clear height.
3.14 Product substitutions, site constraints and variations are governed by sections 7 and 8.
4. Altitude Collection Promotion
4.1 The Altitude Collection applies to eligible projects expressly identified as receiving the collection in the New Home Tender.
4.2 The reference brochure states that the offer commenced on 21 October 2024. The applicable version and current availability must be confirmed before the initial tender request fee is paid.
4.3 The promotional collection price is $4,990 including GST. This is the collection price, not the initial tender request fee, Building Contract deposit or total price of the home.
4.4 The amount and treatment of the initial tender request fee must be separately disclosed in writing before payment, including whether it is credited toward any later amount.
4.5 To secure the collection, the Client must elect the Altitude Collection and pay the disclosed initial tender request fee while the offer is available. Trend will confirm the election, collection price and applicable Procedure of Purchase milestones in writing.
4.6 Any milestones required to retain the offer must be objectively stated, dated and provided before the Client pays to secure it. Where a Client misses a material milestone for reasons within their control, Trend will explain the issue and allow a reasonable opportunity to remedy it before withdrawing the benefit.
4.7 Delays caused by Trend will not cause loss of the collection. Other delays outside the Client’s reasonable control will be fairly assessed, with any revised dates recorded in writing.
4.8 Kitchen upgrades comprise the specified:
- 20mm benchtop.
- Classic bowl and strainer sink.
- Soho sink mixer.
- 900mm dual-fuel freestanding cooker.
- 900mm rangehood.
- 600mm dishwasher space and connections.
Gas availability, appliance models and installation requirements must be addressed in the Project Documents.
4.9 Bathroom upgrades comprise the specified:
- 20mm benchtop.
- Caroma semi-recessed basin.
- Eco rain shower and Soho wall, bath and basin mixers.
- Wish accessories in the available chrome or black range.
- Two semi-frameless shower screens.
- Two standard-size shower niches.
- Two heat/light/fan units.
Coverage depends on the standard home’s fixture configuration, as disclosed in the collection schedule.
4.10 Living upgrades comprise:
- 20 downlights to living areas.
- 600 × 600mm floor tiles from the Builder’s Range to scheduled areas.
- Bosch four-zone home security alarm.
- Reverse-cycle ducted air conditioning.
- 2340mm front door with entry handle and lock.
- Stacker door to the alfresco opening specified in the plans.
4.11 The ceiling-height upgrade is 2600mm to the ground floor. It does not upgrade every floor of a double-storey home unless separately agreed.
4.12 Exterior upgrades comprise the specified:
- Roof ventilation.
- Motorised garage door.
- Selected concrete-tile or steel-roofing option.
- Solar energy system.
- Colour-on concrete driveway.
Roofing options are alternatives and do not create an entitlement to both. Installation specifications and scope must be recorded under clause 3.10.
4.13 The Altitude Collection cannot be combined with another promotional offer unless that offer expressly permits it. It cannot be combined with The Studio Collection or the $30,000 Bonus Upgrade Promotion.
5. The Studio Collection Promotion
5.1 The Studio Collection applies to eligible projects whose New Home Tender expressly includes the collection.
5.2 Under the reference brochure, eligibility requires the Client to visit Trend’s Menangle Park display homes. Any extension to other clients must be confirmed by Trend in writing before commitment. An Oran Park visit alone does not establish eligibility.
5.3 The brochure describes a package of $50,000 of luxury upgrades. This is a package-value claim, not a $50,000 cash payment or freely spendable upgrade credit.
5.4 The collection is included in the quoted home price where expressly identified in the New Home Tender. Any separate collection charge must be clearly disclosed before acceptance and be consistent with the offer made to that Client.
5.5 Kitchen upgrades comprise the specified:
- 20mm benchtop.
- Classic bowl and strainer sink.
- Soho sink mixer.
- 900mm freestanding cooker.
- 900mm rangehood.
- 600mm dishwasher space and connections.
The cooker’s model and fuel type must be specified in the Project Documents.
5.6 Bathroom upgrades comprise the specified:
- 20mm benchtop.
- Full-height tiling to the scheduled bathrooms.
- Two semi-frameless shower screens.
- Caroma semi-recessed basin.
- Eco rain shower and Soho wall, bath and basin mixers.
- Wish accessories in the available chrome or black range.
- Two heat/light/fan units.
- Two standard-size shower niches.
The collection schedule must identify the rooms, wall coverage, tile range and fixtures supplied. Separate laundries or powder rooms do not receive full-height tiling unless expressly included.
5.7 Living upgrades comprise:
- 20 downlights to living areas.
- 600 × 600mm floor tiles from the Builder’s Range to scheduled areas.
- 2340mm internal doors, excluding robes.
- Bosch four-zone home security alarm.
- Reverse-cycle ducted air conditioning.
- 2340mm front door with entry handle and lock.
- Stacker door to the specified alfresco opening.
5.8 The Studio Collection includes 2600mm nominal ceiling heights to all floors of the selected home. Any design-specific departure must be clearly disclosed and agreed before commitment.
5.9 Exterior upgrades comprise the specified:
- Roof ventilation.
- Motorised garage door.
- Solar energy system.
- Colour-on concrete driveway.
The Studio brochure does not separately promise Altitude’s choice of concrete-tile or steel roofing. The applicable roofing is as specified in the New Home Tender.
5.10 The collection must be redeemed within 365 days from acceptance of its associated New Home Tender.
For this purpose, redemption means [CONFIRM AND INSERT THE REQUIRED MILESTONE, SUCH AS ENTERING INTO THE BUILDING CONTRACT THAT INCORPORATES THE COLLECTION].
Trend will state the resulting calendar deadline in writing when the New Home Tender is accepted.
5.11 If the agreed redemption deadline passes without redemption, the offer expires unless extended in writing. Trend will not rely on a delay caused by Trend to forfeit the benefit and will reasonably assess extensions for circumstances outside the Client’s reasonable control.
5.12 A collection already incorporated into a signed Building Contract does not cease to apply merely because construction or installation occurs after the redemption deadline.
5.13 The Studio Collection cannot be combined with the Altitude Collection or the $30,000 Bonus Upgrade Promotion. Where a Client is eligible for multiple offers, the selected offer must be recorded before commitment.
6. $30,000 Bonus Upgrade Promotion
Offer and eligibility
6.1 Subject to these Terms and Conditions, an eligible Client receives one credit of up to $30,000 including GST toward approved additional upgrades selected during colour appointments at Project:Home.
6.2 This is a standalone promotion. It cannot be combined with the Altitude Collection, The Studio Collection or another Trend promotional offer, voucher, discount or upgrade credit.
6.3 The following definitions apply:
- Promotional Day: Sunday, 8 November 2026.
- Eligible Display Homes: Trend’s Richmond 38 and Verona 38 display homes at HomeWorld Oran Park, NSW.
- Registration: providing the information reasonably required to record the Client’s in-person attendance and participation in the promotion.
- Qualifying Deposit: $5,000 including GST paid to Trend for the nominated project under the applicable written preliminary, tender-request or Building Contract documentation.
- Redemption Deadline: 11:59pm on 8 December 2026.
- Household: the Client, their spouse or de facto partner, and entities controlled by either or both of them.
- Upgrade Credit: the promotional credit described in clause 6.1.
6.4 To qualify, the Client must:
(a) be at least 18 years old;
(b) attend at least one Eligible Display Home in person during its opening hours on the Promotional Day;
(c) speak with an authorised Trend New Home Consultant and complete Registration on that day;
(d) pay the Qualifying Deposit in cleared funds by the Redemption Deadline;
(e) propose to build an eligible home with Trend on one nominated Lot; and
(f) satisfy Trend’s normal site, design, finance and contractual acceptance requirements, applied reasonably and disclosed before payment where material.
6.5 An eligible home is one new Main Dwelling or one Duplex to be constructed by Trend on one Lot under one Building Contract, within an area where Trend accepts the project.
6.6 The promotion excludes land-only purchases, house-and-land packages and the purchase of an existing or completed display home.
6.7 The promotion is for new clients for the relevant project. It is not available where the Client or another member of the Household paid an initial tender request fee or deposit, or entered into a Building Contract for that project, before 8 November 2026.
6.8 Cancelling, renaming or re-submitting an existing project does not create a new entitlement. Earlier enquiries, quotations or display visits without a paid fee, deposit or signed Building Contract do not alone disqualify a Client.
6.9 The promotion is limited to one Upgrade Credit per Household, one per Lot and one per Building Contract.
6.10 A Duplex receives a total Upgrade Credit of up to $30,000 for both dwellings together, not $30,000 per dwelling. The credit may be allocated across approved upgrades to those dwellings.
6.11 A dual-living home receives one credit. No additional credit applies to a granny flat, detached structure or secondary dwelling.
Securing the offer
6.12 Trend will provide the applicable promotional terms and the document governing the Qualifying Deposit before payment.
6.13 Attendance or Registration alone does not secure the offer. Once the eligibility requirements are met and the Qualifying Deposit is received, Trend will confirm the Upgrade Credit in writing.
6.14 An administrative delay by Trend in recording or confirming an otherwise valid registration or payment will not defeat eligibility. Clients should allow for their payment provider’s processing times.
6.15 The Qualifying Deposit is not a separate purchase price for the Upgrade Credit. Its purpose, refundability and application toward later amounts are governed by the agreement under which it is paid and applicable law.
6.16 These Terms and Conditions do not make the Qualifying Deposit automatically non-refundable, authorise a deposit above a lawful limit or waive cooling-off or insurance requirements.
6.17 No minimum Building Contract value or separate fixed contract-signing deadline applies under this promotion. The Client must proceed with an eligible home and complete selections within the agreed project timetable.
Eligible upgrades
6.18 Eligible Upgrades are additional items or improvements:
(a) offered through Project:Home for the Client’s home;
(b) selected during scheduled colour appointments;
(c) technically suitable for the project; and
(d) expressly approved for inclusion in the Project Documents.
6.19 Depending on the available studio range and the approved installation scope, Eligible Upgrades may include:
- Cabinetry and joinery upgrades.
- Benchtops and splashbacks.
- Appliances and sinks.
- Tapware, sanitaryware and bathroom accessories.
- Tiles and flooring.
- Paint finishes.
- Doors and hardware.
- Lighting and electrical selections.
- Available comfort upgrades, including air-conditioning upgrades.
6.20 Only the incremental price above the Client’s included baseline item or allowance qualifies. Where an item is entirely additional, its approved supply and installation price may qualify.
6.21 Trend will identify the baseline inclusion or allowance, additional upgrade price and credit applied in the selections or variation schedule.
6.22 Upgrade prices must be consistent with ordinary Project:Home pricing for comparable work at the time of selection. The promotion does not justify increasing prices because the Client has an Upgrade Credit.
Exclusions
6.23 The Upgrade Credit cannot be used to pay or reduce:
(a) the base home price;
(b) the Qualifying Deposit or tender request fee;
(c) land costs or finance costs;
(d) the purchase price of an inclusion collection;
(e) unrelated contractual amounts;
(f) retrospective upgrades already paid for; or
(g) purchases from external retailers or separately engaged suppliers.
6.24 The Upgrade Credit excludes:
(a) structural design changes, floorplan changes, extensions, additional rooms or additional floor area;
(b) engineering, design, consultant, certifier, council, developer or other approval fees;
(c) demolition, excavation, contamination treatment, slab and footing work, site works, drainage and service connections;
(d) mandatory site-compliance work, including bushfire, flood or acoustic measures;
(e) landscaping, fencing, retaining walls, driveways, paving, decks, pergolas and swimming pools;
(f) detached structures and secondary dwellings; and
(g) furniture, loose décor and window furnishings.
6.25 An item’s appearance in a display home, photograph or render does not make it an Eligible Upgrade.
Selection and application
6.26 Trend will assess upgrade suitability reasonably, considering design compatibility, available products, approvals, engineering, safety and buildability. Trend will explain a material refusal and, where reasonably available, offer an eligible alternative.
6.27 The promotion does not guarantee a particular product, model, brand or design outcome. It must not be administered so as to unreasonably prevent use of the promised credit.
6.28 Approved Eligible Upgrade costs up to $30,000 including GST are offset by the Upgrade Credit.
6.29 If approved Eligible Upgrades total less than $30,000, the unused balance is forfeited after final selections and has no cash, refund or transferable value.
6.30 If approved Eligible Upgrades exceed $30,000, the Client must pay the excess under the agreed Project Documents.
For example:
- $24,000 of Eligible Upgrades uses $24,000 of credit, with the remaining $6,000 forfeited.
- $36,000 of Eligible Upgrades uses the full credit, with $6,000 payable by the Client.
These provisions do not remove a remedy for Trend’s failure to supply an agreed benefit.
6.31 The Client must finalise and approve selections within the agreed project timetable. The credit will be recorded in the applicable tender, selections, variation or contract pricing documentation and will not be deducted twice.
6.32 The credit must relate to the same eligible home and Building Contract. It is not a gift card, cash rebate or entitlement to purchase goods independently from Project:Home.
6.33 If an approved item becomes unavailable or unsuitable, section 8 applies.
6.34 If the Client requests deletion or reduction of an upgrade, the credit is recalculated against the remaining Eligible Upgrades. This does not create a refund of promotional value or remove a refund otherwise payable for amounts actually paid.
Changes, cancellation and administration
6.35 The Upgrade Credit is personal to the eligible Client and cannot be sold, assigned, split across projects or transferred to another Household.
6.36 A genuine change of contracting entity, Lot or design must be disclosed. Trend will assess continued eligibility reasonably. An administrative change does not automatically remove the credit where the same eligible Household and project remain.
6.37 The promotion lapses if:
(a) the Qualifying Deposit is not paid by the Redemption Deadline;
(b) the Client voluntarily withdraws from the project;
(c) the project ceases to satisfy the eligibility requirements; or
(d) the qualifying payment is legitimately reversed or refunded so that it is no longer held or applied to the project.
6.38 A disputed payment or a request to enforce a statutory right will not, by itself, be treated as cancellation. Where practicable, Trend will notify the Client of a remediable eligibility issue before withdrawing the benefit.
6.39 If the Building Contract is cancelled, terminated or rescinded, the signed agreement and applicable law govern payments and remedies. Unused promotional credit is not automatically payable in cash. The Client does not owe $30,000 merely because the project ends.
6.40 Trend may reasonably request evidence of attendance and Registration, including CRM records, registration forms or consultant notes. A deliberate material misrepresentation or duplicate claim may result in rejection after the Client has a reasonable opportunity to respond.
6.41 This promotion is not a lottery, competition or prize draw. Eligible clients receive the stated benefit without random selection.
6.42 Trend may change or withdraw the offer for future participants before the Promotional Day, subject to applicable law and commitments already made. After Registration on the Promotional Day, changes will not disadvantage that registered Client unless required by law or expressly agreed.
6.43 Marketing consent is separate from promotional eligibility. Unsubscribing from marketing does not cancel an otherwise valid Upgrade Credit.
7. Pricing, Site Conditions and Approvals
7.1 Website prices, brochures, calculators and general estimates are guides unless expressly offered as binding quotations. Prices must be read with their stated design, façade, inclusions, site assumptions, location, date and exclusions.
7.2 A base price is not a complete site-specific project price unless expressly stated.
7.3 Tender validity periods, inclusions, allowances, exclusions, fees and payment obligations must be identified in writing. A later price change does not automatically alter an accepted fixed-price agreement.
7.4 Preliminary site opinions are subject to appropriate investigations, including survey, geotechnical testing, engineering, service information and planning controls.
7.5 Additional costs may arise from rock, spoil removal, unsuitable or contaminated soil, slope, access restrictions, retaining requirements, additional footings, drainage, existing structures, easements, utility relocation and authority requirements. Included allowances must be distinguished from additional work.
7.6 These Terms and Conditions do not promise a universal cut-and-fill allowance, piering depth, driveway area or site-cost cap. Any such allowance must be identified in the project-specific pricing.
7.7 Extra charges require a proper contractual basis and disclosure. These Terms and Conditions do not authorise charging the Client to correct Trend’s own defective work.
7.8 Designs and materials remain subject to applicable planning controls, developer requirements, the National Construction Code, BASIX and other laws. An inclusion package does not guarantee approval, a complying development pathway or suitability for every Lot.
7.9 Customisation may affect pricing, engineering, approvals and timing. Trend will explain and document those effects before proceeding with a chargeable change.
7.10 Solar and air-conditioning inclusions do not guarantee a particular electricity bill, saving, feed-in return or temperature outcome in all conditions. Agreed specifications, performance commitments and statutory guarantees remain enforceable.
7.11 Any assumptions about rebates, certificates, network export limits or assignment of benefits must be disclosed and agreed in the relevant Project Documents.
7.12 Estimated approval, commencement and completion dates are subject to their stated assumptions. Contractual time obligations and lawful extensions are governed by the Building Contract.
7.13 Separately advertised house-and-land packages must identify the relevant land seller, contracts, price components and availability assumptions. Displaying a package does not itself guarantee land ownership, reservation, finance approval, rental return or investment performance.
8. Product Availability, Substitutions and Variations
8.1 Samples, photographs and screen representations are guides to appearance. Natural grain, veining and reasonable manufacturing variations may occur, but products must still satisfy the agreed specification, applicable standards and consumer guarantees.
8.2 If an agreed product becomes discontinued, unavailable, prohibited or unsuitable for the approved design, Trend will notify the Client and explain the reason.
8.3 Where reasonably available, Trend will propose a lawful alternative of comparable function and quality and equal or greater value at no extra cost where the substitution arises solely from supplier availability.
8.4 Material changes to appearance, function, specification, price or scope require the Client’s agreement and any variation formalities required by the Building Contract and law.
8.5 Where no reasonable equivalent exists or agreement cannot be reached, the parties’ rights are governed by their contract and applicable law. Trend does not have a blanket right to substitute products without notice.
8.6 Client-requested upgrades and additional requirements arising from site conditions or authorities must be separately explained and dealt with through the proper contractual process. Supplier substitutions are not an automatic basis for increasing an agreed price.
8.7 Client approval of selections or drawings confirms the Client’s choices. It does not transfer responsibility for professional design, legal compliance or construction accuracy from Trend to the Client.
9. Warranties, Insurance and Maintenance
9.1 Nothing in these Terms and Conditions excludes, restricts or modifies rights or remedies under the Australian Consumer Law, the Home Building Act 1989 (NSW), applicable statutory warranties, required insurance or any other law that cannot lawfully be excluded.
9.2 NSW statutory warranty periods are generally six years for major defects and two years for other defects from completion, subject to statutory rules and applicable extensions. A brochure reference to a six-year structural warranty does not limit the wider statutory warranties or other available remedies.
9.3 These Terms and Conditions do not create an additional lifetime structural guarantee.
9.4 The 90-day maintenance period described in the Standard Inclusions brochure is an initial reporting and service period. It is not a deadline that extinguishes legal rights.
9.5 Clients should report defects promptly through their client contact. Reasonable access will be arranged for investigation and rectification. Urgent safety concerns should be reported immediately.
9.6 Manufacturer warranties supplement and do not replace rights against Trend. A Client is not required to pursue a manufacturer instead of Trend where Trend has an obligation under law or the Building Contract.
9.7 Clients should follow reasonable care and maintenance instructions. Damage caused by misuse, inadequate maintenance or third-party work will be assessed on its facts and does not automatically cancel warranties for unrelated work.
9.8 Trend will maintain insurance required for the work and provide required Home Building Compensation documentation where applicable. Deposits and other payments must comply with applicable legal and insurance requirements.
10. Website Information, Plans and Display Imagery
10.1 Trend takes reasonable care in preparing website information, but content may change or contain errors. Clients should obtain current project-specific information before committing. This does not remove Trend’s responsibility for information or representations it provides.
10.2 Plans, photographs, renders, virtual tours, artist’s impressions and display homes are illustrative unless expressly incorporated into the Project Documents.
10.3 Marketing materials and display homes may show optional upgrades, non-standard façades, furniture, landscaping, window furnishings, lighting, pools and other items outside the advertised price. Material exclusions must be clearly disclosed with the relevant offer.
10.4 Colours, textures, lighting, views, landscaping maturity and surrounding development may differ from illustrative material. Drawings should not be scaled for construction. Dimensions must be checked against the working drawings and stated measurement method.
10.5 Awards, ratings, testimonials and performance claims relate to their stated source, category, date and relevant business or project. They do not guarantee the outcome of every project.
10.6 Calculators and estimates depend on their disclosed assumptions and are not personal financial, tax or planning advice.
10.7 The website must not be used unlawfully, to infringe another person’s rights, to introduce malicious code or to interfere with website security. Trend may take proportionate steps to protect the website against misuse.
11. Copyright
11.1 © 2026 Trend Connection Pty Ltd ABN 45 101 504 205. All rights reserved, except as permitted by law or an applicable licence.
11.2 Copyright in this website subsists under the Copyright Act 1968 (Cth). Website content is owned by Trend or used under licence unless otherwise stated.
11.3 You may access this website and download or print reasonable copies of publicly available information for personal, non-commercial use, unless that use is expressly restricted. Copyright notices must be retained.
11.4 You must not on-sell or otherwise commercialise information obtained from this website without the relevant rights holder’s written permission.
11.5 Except as permitted by the Copyright Act 1968 (Cth), another applicable law, a written agreement or these Terms and Conditions, website content must not be reproduced, adapted, stored, distributed, printed, displayed, performed, published, communicated or transmitted in any form or by any means without the relevant rights holder’s written consent.
12. Intellectual Property Policy
12.1 Plans, designs, drawings, façades, illustrations, photographs, renders, videos, logos and other materials produced by or for Trend are owned by Trend or used under licence, subject to the applicable agreements and law.
12.2 Third-party material remains the property of its owner. Trend does not claim ownership merely because material has been supplied by a Client or third party.
12.3 Access to a plan, image or display home does not grant a licence to construct, substantially reproduce or commission another builder to construct a protected Trend design.
12.4 Rights to use designs commissioned or paid for by a Client depend on the applicable design or preliminary agreement and law. Payment alone does not determine ownership or the scope of a licence.
12.5 Clients may share publicly available material with professional advisers for the genuine assessment of a proposed Trend project, subject to any confidentiality or licence restrictions notified with that material.
12.6 A Client supplying third-party plans, images or other material must have the permission reasonably required for Trend’s agreed use. Trend may request evidence before using that material.
12.7 Trend’s names, logos and trade marks must not be used to imply endorsement, association or authority without permission, subject to uses permitted by law.
12.8 Intellectual property enquiries may be sent to [email protected].
13. Outbound Links
13.1 Links to independently operated websites are provided for convenience.
13.2 Unless expressly stated, a link does not represent endorsement or approval of the linked website, organisation, products, services or content.
13.3 Third-party websites operate under their own terms and privacy practices. Clients should review those terms before providing information or making a purchase.
13.4 Trend does not control independently operated websites and is not responsible merely because it provides a link. This does not exclude liability for Trend’s own representations, conduct or legal obligations concerning a linked service.
14. Disclaimer of Liability
14.1 Subject to applicable law, Trend does not promise that general website content will be continuously available, error-free or suitable for every proposed use.
14.2 General website information does not replace project-specific investigations, professional advice or the agreed Project Documents. This does not remove responsibility for representations made by Trend.
14.3 To the extent permitted by law, Trend is not responsible for loss caused solely by unauthorised website alterations, independently operated third-party systems or a user’s unlawful misuse, except to the extent Trend’s own act, omission, negligence, breach or legal obligation contributed to the loss.
14.4 Nothing in these Terms and Conditions excludes liability for misleading or deceptive conduct, fraud, breach of a non-excludable consumer guarantee or statutory warranty, or another liability that cannot lawfully be limited.
14.5 These website provisions do not override a specific written commitment, impose a blanket exclusion of all direct or indirect loss or limit remedies available under a Building Contract or applicable law.
15. Privacy, Marketing and Event Registration
15.1 Trend collects contact, registration and project information reasonably necessary to respond to enquiries, verify promotional eligibility, administer selections and progress projects.
15.2 Personal information is handled in accordance with applicable law and Trend’s Privacy Policy.
15.3 Relevant information may be provided to Project:Home, service providers, consultants and other parties where reasonably necessary for the stated purpose and permitted by law, as explained in the Privacy Policy.
15.4 If information required to verify promotional eligibility is not provided, Trend may be unable to verify a claim. Trend will explain what is required rather than require unrelated information.
15.5 Promotional emails, SMS and marketing calls will be sent only where legally permitted. Marketing consent is separate from acceptance of promotional terms.
15.6 Clients may opt out of marketing using the available unsubscribe mechanism or by contacting Trend. Opting out does not remove an otherwise valid promotional benefit or prevent necessary project communications.
15.7 Attendance at a display home or event does not constitute blanket permission to use an identifiable person’s image, testimonial or personal details in advertising. Any required permission will be obtained separately, including appropriate permission for images of children.
15.8 These Terms and Conditions do not replace the Privacy Policy, collection notices or disclosures required for cookies, analytics and advertising technology used on the website.

Email: [email protected]
Phone: 1300 916 178
16.2 Clients should provide their project reference and details of the issue. Trend will acknowledge and assess complaints within a reasonable time and explain its response.
16.3 Clients may access applicable external complaint or dispute-resolution processes, including Building Commission NSW, NSW Fair Trading or NCAT where relevant.
16.4 These Terms and Conditions do not require a Client to abandon a statutory remedy or complete Trend’s internal process before exercising a right where the law does not require that.
16.5 Promotional approvals, exceptions and extensions should be recorded in writing by an authorised Trend representative. A failure to record something does not exclude a right arising under law or a representation for which Trend is responsible.
16.6 Failure to exercise a right immediately does not necessarily waive that right.
16.7 If a provision is unlawful or unenforceable, it is severed to the extent necessary without affecting the remaining provisions where they can lawfully operate.
16.8 These Terms and Conditions are governed by NSW law. The parties submit to the non-exclusive jurisdiction of courts and tribunals with authority in NSW, without restricting any mandatory jurisdiction or consumer right.
